What's the best thing to do when the girl friend is out of town besides have threesomes and eat burgers? Why, play sauerbraten on a gamecube of course! :P

This is fair use. Obviously they used a free game becuase a big company like Activision or EA might sue them anyway. This does not mean it's copyright infringement, it just means that big companies are too aggressive about sueing people.

So they did contact you first.. then meh, plus I doubt the 'official Sauerbraten legal team' could take on Burger King.
For the record, Burger King in Australia can't afford advertisements anymore.

@metlslime
Because you can find it on the internet and it is a open source game does not mean that you can use it in a commercial for free. It simply does not work that way, and certainly a company like BK should know this.
Open source does not grant you the right make a advertisement out of content from that program.

which TV channels would you broadcast on?
who'd you hire to do it?
If you decide to broadcast your home-video of how your playing sauerbraten on your local "open mike"-TV-Channel (dunno if that's the correct term) ... the answer'd be : nothing
On the other end : the sky's the limit ;-)
