Its hardly advertising, because unless the viewer has an extremely sharp eye AND knowledge of Sauerbraten before, the 'advertising' is totally useless.
Its an advertisement for burgers, not Sauerbraten. Burger King needed a free game they could show on the advertisement, they Googled 'free fps game' and found Sauerbraten on some lameo mirror site that had a super old version.
Cool though.

I have watched the Burger king advert and it IS cube 2. It\\\\\\\'s cool to see it on the T.V but didn\\\\\\\'t they get any permission from Aardappel?
I bet Aardappel was like WTF? when he first saw the advert. In his own right he could sue Burger King as they used Cube 2 on their advert without permission.
Cube must be starting to get known by people and it\\\\\\\'s good to spread the word, because both Cube and Cube are great games! :D

Guys, isn't the game open source, right?
Really, only the mappers should have been questioned if they want their maps in the advert, not the maker of the game (Remember as somebody said here, if you are modifying sauerbraten, you cannot use any maps (content) without permission!) :)
So the best way to make a mod for people is to actually create some binaries that use the content :)

Actually, most of the models, textures, and maps in Sauer have certain license encumbrances involved in them. Only the source code is open.

This is fair use. Obviously they used a free game becuase a big company like Activision or EA might sue them anyway. This does not mean it's copyright infringement, it just means that big companies are too aggressive about sueing people.

So they did contact you first.. then meh, plus I doubt the 'official Sauerbraten legal team' could take on Burger King.
For the record, Burger King in Australia can't afford advertisements anymore.

Because you can find it on the internet and it is a open source game does not mean that you can use it in a commercial for free. It simply does not work that way, and certainly a company like BK should know this.
Open source does not grant you the right make a advertisement out of content from that program.
